These Terms and Conditions (the “Terms”) are a legal agreement between you and Wichita Animal Action League, Inc. (“WAAL,” “we,” “us,” or “our”), a 501(c)(3) nonprofit animal welfare organization in Wichita, Kansas, and govern your access to and use of the website located at waalrescue.org, including any content, functionality, forms, applications, and services offered on or through it (collectively, the “Site”).
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not access or use the Site.
Our forms and applications are meant for adults 18 and older. If you submit a form on behalf of another person or an organization, you represent that you have the authority to do so.
We may revise these Terms at any time and for any reason. Any changes are effective when posted, and we will alert you by updating the “Last Updated” date at the top of this page. You are responsible for reviewing these Terms periodically. Your continued use of the Site after changes are posted means you accept the revised Terms.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
We may suspend or terminate your access to the Site, or decline an application, without notice, if we believe you have violated these Terms.
The Site includes information about pet care, health, behavior, training, spay/neuter, vaccinations, rehoming, pet-friendly housing, and community resources. This content is provided for general informational purposes only. It is not veterinary, medical, behavioral, or legal advice, and it is not a substitute for an examination by a licensed veterinarian or advice from a qualified professional who knows your situation. If your pet is sick or injured, contact a veterinarian right away.
Animal descriptions, photos, ages, breeds, temperaments, and medical histories are based on the information available to us and our fosters and may be incomplete or change over time. We cannot guarantee the health, behavior, or breed of any animal.
Submitting a form or application on the Site does not guarantee approval, an appointment, an adoption, financial assistance, or any other service. We review applications according to our program rules, eligibility criteria, available funding, and capacity, and we may approve, deny, or wait-list any application at our discretion.
Adoptions, fostering, rehoming and surrenders, Spay It Forward and other spay/neuter services, veterinary care assistance, training assistance, pet supplies, and volunteer service are provided only under the program’s own application, contract, waiver, or agreement that you sign or accept (each, an “Agreement”). Fees, eligibility, scheduling, cancellation and refund rules, medical risks, releases of liability, and all other program terms are governed by the applicable Agreement. Veterinary services are performed by independent licensed veterinarians and clinics, not by WAAL. If there is any conflict between these Terms and an Agreement, the Agreement controls for the program it covers.
Information on the Site, including fees, dates, locations, and program availability, may change at any time without notice.
Donations and program payments made through the Site are processed by third-party payment and donation providers, whose own terms and privacy policies also apply. WAAL is a 501(c)(3) organization (EIN 46-5635359), and donations are tax-deductible to the extent allowed by law; we will send an acknowledgment for your records. Donations are generally non-refundable. If you believe a donation or payment was made in error, contact us within thirty (30) days and we will work with you to resolve it. Refunds of program fees are governed by the applicable program’s Agreement.
The Site allows you to contact us and apply for our programs through forms, email, telephone, and text message. When you submit information to us, you represent that it is accurate and complete, that you have the right to provide it, and, if you give us information about another person (such as a reference, landlord, or veterinarian), that you have their permission to do so.
By submitting a form or application, you authorize us to use the information you provide to respond to you, to review and process your application (including contacting your veterinarian, landlord, or references where the application says so), and to provide the program or service you requested. Our collection and use of personal information is described in our Privacy Policy.
If you send us photos, videos, stories, or animal profiles (for example, through our foster Animal Profile Builder), you grant WAAL a non-exclusive, royalty-free, perpetual license to use, edit, and publish them on the Site, social media, and in our promotional and fundraising materials, and you confirm that you have the right to grant that license.
When you use the Site, submit a form, or send us an email or text message, you are communicating with us electronically. You consent to receive communications from us electronically, including by email and telephone, and, if you opt in through our Spay It Forward application, by text message as described in these Terms, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. Waivers and agreements you sign electronically on the Site have the same effect as a handwritten signature.
If you provide a telephone number, you agree that we may call you at that number about your inquiry, application, or appointment. We send text messages only through our Spay It Forward SMS Program described below, and only to people who opt in to it. We will send text messages or make calls using automated technology or prerecorded messages only where you have given the consent required by applicable law, and you may withdraw that consent at any time as described below.
Wichita Animal Action League, Inc. (WAAL) offers a text messaging program (the “SMS Program”) for applicants to Spay It Forward, our low-cost spay/neuter program. The SMS Program is used only for Spay It Forward; we do not text people about our other programs, forms, or inquiries. By providing your mobile phone number on the Spay It Forward application and opting in (by checking the optional text message consent box on the application, or by telling our staff that you want texts after they read you these terms), you agree to receive recurring automated text messages from WAAL Spay It Forward at the number you provided. These messages may include Spay It Forward application updates, reminders to finish payment, scheduling, or waiver signing, appointment reminders and drop-off details, requests to confirm your appointment (reply YES), and replies to messages you send us. We do not send marketing or fundraising text messages through the SMS Program.
The information (phone numbers) obtained as part of the SMS consent process will not be shared with third parties or affiliates for marketing or promotional purposes.
If you have consented to receive text messages from Wichita Animal Action League, Inc., you may receive messages about your Spay It Forward application and appointment, related to the following:
Message frequency varies. Most Spay It Forward applicants receive 2 to 6 messages per appointment, plus replies to any messages you send us. We send texts only between 8 a.m. and 8 p.m. Central time.
Standard message and data rates may apply, depending on your carrier’s pricing plan. WAAL does not charge for text messages.
You may opt in to receive SMS messages from Wichita Animal Action League, Inc. through the following method(s):
You can opt out of receiving SMS messages at any time by replying STOP to any message you receive. You can also reply UNSUBSCRIBE, CANCEL, END, QUIT, STOPALL, REVOKE, or OPTOUT, or contact us by phone or email to request removal from our messaging list. We will send one final message confirming that you have been unsubscribed, and then no more. To start again, reply START or check the box on a new Spay It Forward application.

If you do not wish to receive SMS messages, please leave the text message consent box unchecked on the Spay It Forward application. You never have to agree to texts to apply for, schedule, pay for, or receive Spay It Forward or any of our other programs or services.
Mobile carriers are not liable for delayed or undelivered messages. Texts are a convenience; please also watch your email, which remains our main way to send approvals, payment links, and waivers. Please tell us if you change or give up your mobile number. If you are not the account holder for the number you provide, you confirm that you have the account holder’s permission to sign up.
We may modify or discontinue the SMS Program at any time. These SMS terms are part of these Terms and Conditions.
The Site and its entire contents, features, and functionality, including all text, graphics, photographs, images, videos, logos, and the design, selection, and arrangement of the Site, are owned by WAAL or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
“Wichita Animal Action League,” “WAAL,” “Spay It Forward,” and the related logos are marks of Wichita Animal Action League, Inc. Other names and marks appearing on the Site are the property of their respective owners and are used for identification only. Nothing in these Terms grants you any right to use our marks without our prior written consent.
You may view, download, and print pages from the Site, and share links to our pages and adoptable animals, for your own personal, non-commercial use. You may not otherwise reproduce, distribute, modify, create derivative works from, publicly display, republish, or exploit any content from the Site without our prior written permission.
The Site may include content from, and links to, third parties, such as adoption, donation, event, and newsletter platforms, veterinary clinics, partner organizations, government agencies, and social media. We provide these for your convenience. We do not control third-party websites or content, we are not responsible for their accuracy or availability, and a link or reference does not mean we endorse the third party or that the third party endorses us. Your use of third-party websites is subject to their own terms and policies.
The Site uses cookies and similar technologies, including cookies set by third-party services such as analytics, security, spam-protection, payment, donation, adoption, and embedded video providers. These technologies help the Site function, keep it secure, and help us understand how visitors use it. The types of cookies we use, the services that set them, and how you can manage or disable them are described in the Cookie Policy section of our Privacy Policy. By continuing to use the Site, you acknowledge our use of cookies as described there. You may block or delete cookies through your browser settings, but some features of the Site, including our forms and payment pages, may not work properly without them.
THE SITE AND ALL CONTENT ON IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WAAL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.
This disclaimer applies to the Site only. Terms for our programs and services, including any releases of liability, are stated solely in the applicable Agreement.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WAAL, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, FOSTERS, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY CONTENT ON IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, OUR TOTAL LIABILITY ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. This section does not limit any liability that cannot be limited under applicable law, and it does not apply to liability under an Agreement, which is governed by that Agreement.
You agree to defend, indemnify, and hold harmless WAAL and its directors, officers, employees, volunteers, fosters, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms or your use of the Site, including any information you submit through it.
These Terms and any dispute arising out of or related to them or the Site are governed by the laws of the State of Kansas, without regard to its conflict of law principles. You agree that any legal action arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Sedgwick County, Kansas, and you consent to the personal jurisdiction of those courts. Before filing any action, you agree to first contact us using the information below and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
These Terms, together with our Privacy Policy, are the entire agreement between you and WAAL regarding your use of the Site and supersede any prior understandings regarding the Site. They do not replace or modify any Agreement. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our written consent; we may assign them without restriction.
